Recently the Department of Labor has offered assistance on its Fair Pay website for employers struggling with the new Fair Labor Standards Act regulations governing overtime pay. Specifically, the website contains a sample policy that would, presumably, meet the safe-harbor requirements for full-day salary deductions for violations of workplace conduct rules; a list of frequently asked questions and their answers; and a side-by-side comparison of the old and new regulations. Because the Department of Labor has indicated its intent to step-up enforcement, and has not yet offered much in the way of interpretation, we feel these additions to the website are both valuable and informative.
