Mark Radke practices primarily in the areas of real estate, Common Interest Communities (CIC’s) and homeowner association law, business law, and mergers and acquisitions, with a special emphasis on the structuring, development and operation of common interest communities, multi-family housing and commercial developments, primarily under MCIOA, general transactional work, and commercial leasing. He has substantial experience in the ongoing representation of homeowner associations and the formation and ongoing representation of business partnerships, limited liability companies and other corporate entities, and general contract law.

Mark is certified by the Minnesota State Bar Association as a Real Property Specialist and he is a member of the Committee on Minnesota Common Interest Ownership, which advises the Real Property Council concerning legislation affecting the Minnesota Common Interest Ownership Act (MCIOA).

Mark currently serves as an officer of the firm and as a member of the firm’s Board of Directors and Management Committee.

  • Real estate work involving a variety of development scenarios located in a number of different states, including residential, commercial, mixed-use, master plan communities, multi-component residential and recreational developments, condominium hotels, and casino developments
  • Representation of homeowner associations and homeowner association management companies involving the formation and ongoing operations of homeowner associations
  • Extensive expertise in connection with the Federal Interstate Land Sales Act and the Minnesota Subdivided Land Sales Act, having obtained the successful registration of more than six projects with the Department of Housing and Urban Development under ILSA, as well as numerous projects completed on an exempt basis
  • Transactional work involving a variety of sale, acquisition, financing and related matters in a number of different states, including asset sale and purchase transactions, leasing, real property sale and purchase transactions, stock acquisitions and sales, mergers and attendant financings.
  • Counseled lenders and other financial institutions in connection with the work out, foreclosure and ongoing administration of fractured condominiums and other troubled CIC projects on a national basis.
